01Facts
The applicants—retired Central Excise/Customs officers and the widow of a retired Assistant Commissioner—claimed that the upgraded replacement pay scales granted to their cadres should take effect from 1 January 1996, rather than 21 April 2004, the date specified in the relevant Government orders.
¶ 1–4They relied on the retrospective treatment given to employees in analogous posts and on earlier Tribunal and court decisions concerning the same pay-scale anomaly.
¶ 3–5After their representations were not accepted, they sought retrospective fixation, consequential pensionary benefits and arrears, and challenged the Board’s order dated 25 July 2023.
¶ 3 · Annexure A14The Tribunal considered its earlier ruling in O.A. No. 570/2023 and connected cases, and the Kerala High Court’s judgment dated 15 June 2026 in connected O.P. (CAT) matters.
¶ 8–1002Issues
i.Whether the applicants were entitled to the upgraded replacement pay scales notionally from 1 January 1996, instead of 21 April 2004.
¶ 3–5, 8ii.Whether the applicants were entitled to arrears arising from the retrospective pay-scale revision, and what consequential relief should be ordered.
¶ 9–1103Law Applied
The Tribunal applied the Central Civil Services (Revised Pay) Rules, 1997, which gave effect to revised pay scales from 1 January 1996, in considering the claimed date for the upgraded replacement scales.
¶ 2, 4It followed the consistent Tribunal and court decisions holding that similarly placed officers were entitled to the enhanced replacement scales from that date and that denying them equivalent treatment was discriminatory.
¶ 5, 8Although Union of India v. Tarsem Singh, (2008) 8 SCC 648, had been relied on by the Tribunal in an earlier order to restrict arrears to three years, the Kerala High Court subsequently disapproved that restriction in the connected matters and held that arrears were payable from 1 January 1996.
¶ 904Reasoning
The Tribunal treated the applicants’ claims as materially identical to those resolved in its earlier order and the subsequent Kerala High Court judgment.
¶ 8–10Those decisions established entitlement to the enhanced replacement scales from 1 January 1996, consistent with the treatment of employees in analogous posts.
¶ 8–10The High Court’s ruling also removed the earlier limitation on arrears, so the Tribunal directed payment of arrears rather than limiting recovery to the three years preceding the applications.
¶ 9The Board’s implementation of the earlier decisions further supported the conclusion that the issue was no longer res integra.
¶ 1005Holding
The Tribunal allowed the application and directed the respondents to grant the applicants the enhanced replacement scales notionally from 1 January 1996 and release the resulting arrears within six months of receiving a copy of the order.
¶ 11No costs were ordered.
