01Facts
The seven applicants, serving in Central Tax and Central Excise posts, claimed entitlement to upgraded replacement pay scales from 1 January 1996, the date the CCS (Revised Pay) Rules, 1997 took effect.
¶ 1–4The upgrades had been granted to them from 21 April 2004, although employees holding analogous posts in other departments had received retrospective enhancement from 1 January 1996.
¶ 1–4The applicants sought notional refixation from the earlier date and payment of consequential arrears, as well as relief against the order dated 25 July 2023.
¶ 3The Tribunal noted earlier decisions on the same issue, including its order of 3 December 2025 and the Kerala High Court’s judgment of 15 June 2026, which upheld entitlement from 1 January 1996 and disapproved limiting arrears to three years.
¶ 8–1002Issues
i.Whether the applicants were entitled to the enhanced replacement pay scales from 1 January 1996, rather than from 21 April 2004.
¶ 3–5, 8–10ii.Whether the applicants were entitled to arrears consequent on that retrospective pay fixation, and what directions should issue for payment.
¶ 9–1103Law Applied
The Tribunal applied the CCS (Revised Pay) Rules, 1997, under which the revised pay structure took effect from 1 January 1996.
¶ 4It followed the consistent decisions of the Tribunal and High Courts holding that similarly placed employees in analogous posts were entitled to the enhanced replacement scales from that date, and that denying the same treatment to the applicants was discriminatory.
¶ 5Although the Tribunal’s earlier order had relied on Union of India v. Tarsem Singh, (2008) 8 SCC 648, to limit arrears to three years, the Kerala High Court subsequently upheld retrospective entitlement while disapproving that limitation.
¶ 904Reasoning
The Tribunal considered the applicants’ claim identical to the pay-scale issue addressed in its earlier decisions and noted that the Kerala High Court had affirmed entitlement from 1 January 1996.
¶ 8–10It also recorded that the respondents had implemented the Tribunal and High Court decisions for some employees and that CBIC had issued an implementation order on 27 July 2026.
¶ 8–10In light of those decisions and the implementation already undertaken, the Tribunal extended the same benefit to these applicants and directed payment of arrears without applying the earlier three-year restriction.
¶ 9–1105Holding
The Tribunal allowed the application.
¶ 11It directed the respondents to grant the applicants the enhanced replacement pay scales notionally from the respective dates of commencement of service or 1 January 1996, whichever was earlier, and to release the arrears within six months of receiving the order.
¶ 11No costs were ordered.
