01Facts
Sunil Kumar Rana was appointed as a PTA Lecturer in Mathematics in 1996 and was granted adhoc status under Section 41 of the Uttarakhand School Education Act, 2006, with approval dated 29 June 2009 and an order dated 30 June 2009.
¶ 4–5His institution was provincialised on 21 November 2014, when he was removed on the ground that he lacked a B.Ed. qualification; he obtained that qualification in 2016.
¶ 6–8After his representation was rejected in 2019, he sought relief, including reinstatement and consequential benefits.
¶ 8–10During the petition, he died on 2 February 2026, and his wife, daughter, and son were substituted as petitioners.
¶ 1–2, 8–10He relied on the relief granted to Bhuwan Chandra Papnai in a similar case, whose reinstatement and consequential benefits had been upheld on appeal and followed by dismissal of the State’s SLP.
¶ 9, 13–1402Issues
i.1. Whether the B.Ed. qualification requirement introduced by the 2009 Regulations could retrospectively invalidate Rana’s adhoc status granted before those Regulations came into force.
¶ 11–12, 18ii.2. Whether Rana was entitled to the same relief as Bhuwan Chandra Papnai, notwithstanding the State’s asserted factual distinction and its objection based on delay and laches.
¶ 13, 16–17, 19, 21iii.3. Whether consequential service and monetary benefits could be granted to Rana’s legal representatives after his death, despite no separate amendment seeking such relief.
¶ 3, 22–2303Law Applied
Section 41 of the Uttarakhand School Education Act, 2006, was the basis on which Rana’s adhoc status was granted.
¶ 5, 18Regulations 36–38 of Chapter II of the 2009 Regulations prescribed the qualifications for teachers in government-aided private secondary schools, including a B.Ed. qualification, but the Regulations came into force upon publication in the official Gazette on 10 July 2009.
¶ 11–12, 15, 18The Court applied the principle that a subsequent change in eligibility requirements operates prospectively and does not, without more, extinguish a legal status granted before the change took effect.
¶ 18It also relied on the final determination in Bhuwan Chandra Papnai as supporting equal treatment of similarly situated employees, and considered Article 14 in addressing the claim of discriminatory treatment.
¶ 13, 19–21The petition was considered under Article 226 of the Constitution.

Uttaranchal School Education Act, 2006 Section 41
04Reasoning
Rana’s adhoc status was granted on 30 June 2009, before the 2009 Regulations and their B.Ed. requirement came into force on 10 July 2009. The Court therefore held that the later qualification requirement could not retrospectively remove his status, and noted that the authority had not addressed this point when rejecting his representation.
¶ 18The Court rejected the State’s attempt to distinguish Papnai, reasoning that Rana’s adhoc status under Section 41 had never been cancelled or recalled and that the issue had been finally resolved in Papnai’s favour.
¶ 19It also relied on the unrefuted assertion that another teacher had been allowed time to obtain a B.Ed., while Rana had obtained the qualification after his removal, to support his claim of unequal treatment.
¶ 20The Court rejected laches because Rana sought parity soon after Papnai’s SLP was dismissed and the benefits were implemented.
¶ 21It treated the existing reinstatement prayer as encompassing consequential relief for the substituted petitioners.
¶ 2205Holding
The Court allowed the petition and quashed the Chief Education Officer’s order dated 25 July 2019.
¶ 23It directed the respondents to treat Rana as having remained in service as a Lecturer from 21 November 2014 until his death, with continuity of service and parity with Papnai.
¶ 23(i)The respondents were directed to calculate and pay arrears of salary and other consequential benefits to the substituted petitioners, and to release death-cum-retiral benefits, including gratuity and leave encashment, to the widow.
¶ 23(ii)–(iii)The Court further directed that family pension be sanctioned to the widow, with arrears from 3 February 2026; monetary benefits unpaid within the prescribed periods would carry interest at 6% per annum until payment.
