01Facts
The applicant challenged his disqualification from the Constable (Executive) Male recruitment in Delhi Police Examination, 2025, after his height was recorded as 169.50 cm initially and 169.80 cm on appeal, below the required minimum of 170 cm. He relied on a medical certificate from an earlier Indo-Tibetan Border Police recruitment in 2022, which recorded his height as 171.5 cm. He sought, among other relief, that the disqualification decision dated 22 September 2026 be set aside and that he be appointed.
p. 2The Tribunal was also referred to its order in Naresh Kumar v. SSC & Ors., O.A. No. 3989/2026, dated 12 October 2026, which had granted similar relief.
p. 302Issues
i.1. Whether the applicant’s height should be measured afresh in accordance with the applicable rules and the methodology used for other candidates.
p. 3ii.2. Whether the applicant should be permitted to proceed to the Physical Endurance and Measurement Test and, if successful and otherwise eligible, be considered for appointment.
p. 303Law Applied
The application was brought under Section 19 of the Administrative Tribunals Act, 1985.
p. 2The Tribunal directed that height measurement be conducted strictly in accordance with the applicable rules and instructions and using the methodology adopted for measuring other candidates in the same recruitment. It also relied on its approach in Naresh Kumar v. SSC & Ors., O.A. No. 3989/2026, which had granted similar relief.

Administrative Tribunals Act, 1985 Section 19
04Reasoning
Given the discrepancy between the applicant’s measurements in the current recruitment and the earlier certificate recording a height of 171.5 cm, and having regard to the similar relief granted in Naresh Kumar, the Tribunal considered a fresh measurement to be an appropriate course.
p. 3It directed that the measurement be conducted at an appropriate institution selected by the respondents, under the applicable rules and using the methodology applied to other candidates. The outcome would determine the applicant’s further participation in the recruitment process.
p. 305Holding
The Tribunal disposed of the application by directing the respondents to arrange a fresh height measurement. Within one week after that measurement, they were to take the consequential decision regarding the applicant’s participation in the Physical Endurance and Measurement Test. If he met the height standard, participated in and passed that test, and satisfied the other eligibility conditions, he would be entitled to appointment.
pp. 3–4The directions were to be complied with within three weeks of receipt of the order. Pending miscellaneous applications were also disposed of, with no order as to costs.
