The question

Whether the applicant’s height should be measured afresh in accordance with the applicable rules and the methodology used for other candidates.

The court held

The Tribunal disposed of the O.A. with directions that the respondents arrange a fresh height measurement and, within one week thereafter, take the consequential action regarding the applicant’s participation in the PE&MT. If the applicant meets the height criterion, he must be allowed to undertake the test; if successful, he is entitled to appointment provided he satisfies all other eligibility conditions.

It also directed

The directions are to be complied with within three weeks of receipt of the order. The O.A. was disposed of without an order as to costs; pending miscellaneous applications were also disposed of.

01Facts

The applicant, a candidate for Constable (Executive) Male in the Delhi Police Examination, 2025, was disqualified for not meeting the prescribed minimum height of 170 cm. His height was recorded as 168.30 cm at the initial measurement and 169.10 cm on appeal. He subsequently obtained a certificate from Sir Shadi Lal Civil Hospital, Rewari, recording his height as 172 cm. He sought to have the disqualification set aside and appointment granted, subject to eligibility.

04Reasoning

In light of the conflicting measurements recorded during recruitment and in the applicant’s subsequent medical certificate, and having regard to the similar relief granted in Naresh Kumar, the Tribunal considered a fresh measurement an appropriate means of resolving the dispute.

p. 3

It directed the respondents to arrange the measurement at an appropriate institution, using the applicable rules and the methodology used for other candidates. The applicant’s participation in the PE&MT would depend on the result of that measurement.

p. 3
