Administrative Tribunals Act, 1985 Section 19

04Reasoning

Given the difference between the recruitment measurement and the PGIMS certificate, the Tribunal considered a fresh measurement under the applicable rules and the methodology used for other candidates to be an appropriate means of resolving the dispute.

¶ 2, 4

Rather than ordering measurement specifically by an independent medical board, it left the choice of an appropriate institution to the respondents.

¶ 4

It made further participation conditional on the fresh measurement and the applicant’s success in the PE&MT, while preserving the requirement that he satisfy all other eligibility conditions.

¶ 5

05Holding
