In brief

The question

1. Whether the applicant should be referred for a fresh measurement of his height in accordance with the applicable rules and instructions

The court held

The Tribunal directed the respondents to arrange a fresh height measurement at an appropriate institution, in accordance with the applicable rules and instructions

It also directed

Depending on the result, the respondents were to take consequential action regarding the applicant’s participation in the PE&MT within one week; if he met the height criterion, they were required to conduct the PE&MT

If he participated and succeeded, he would be entitled to appointment subject to all other eligibility requirements.

The directions were to be complied with within three weeks of receipt of the order; the O.A. was disposed of without an order as to costs.

01Facts

The applicant was disqualified from the recruitment process for Head Constable (Ministerial) in Delhi Police after his height was recorded as 163.5 cm at the initial measurement and 164.5 cm on appeal, below the prescribed minimum of 165 cm

p. 2

He relied on a certificate from Civil Hospital, Charkhi Dadri, recording his height as 165.2 cm

pp. 2–3

Citing a similar order in Naresh Kumar v. SSC & Ors., O.A. No. 3989/2026, he sought a fresh measurement and consequential participation in the recruitment process

p. 3

02Issues

i.1. Whether the applicant should be referred for a fresh measurement of his height in accordance with the applicable rules and instructions

p. 3

ii.2. Whether, if found to meet the prescribed height standard, the applicant should be permitted to participate in the subsequent recruitment stages, subject to the applicable eligibility conditions

pp. 3–4

03Law Applied

Section 19 of the Administrative Tribunals Act, 1985, provides the basis for the applicant’s Original Application before the Tribunal

p. 2

The Tribunal directed that height be measured afresh in strict accordance with the rules and instructions governing the subject and using the methodology adopted for other candidates in the same recruitment

p. 3

It also referred to its order in Naresh Kumar v. SSC & Ors., O.A. No. 3989/2026, as involving a similar request

p. 3

Administrative Tribunals Act, 1985 Section 19

04Reasoning

The applicant’s official measurements fell below the 165 cm minimum, while his hospital certificate recorded a height above that threshold

pp. 2–3

In view of this discrepancy, and having regard to the similar order cited by the applicant, the Tribunal considered that a fresh measurement under the applicable rules and the methodology used for other candidates would meet the ends of justice

p. 3

It therefore left the applicant’s further participation contingent on the result of that measurement and his success in the PE&MT, as well as fulfilment of all other eligibility conditions

pp. 3–4

05Holding

The Tribunal directed the respondents to arrange a fresh height measurement at an appropriate institution, in accordance with the applicable rules and instructions

p. 3

Depending on the result, the respondents were to take consequential action regarding the applicant’s participation in the PE&MT within one week; if he met the height criterion, they were required to conduct the PE&MT

pp. 3–4

If he participated and succeeded, he would be entitled to appointment subject to all other eligibility requirements.

p. 4

The directions were to be complied with within three weeks of receipt of the order; the O.A. was disposed of without an order as to costs.
