01Facts

The applicant sought anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with Crime No. 209/2026, registered for alleged offences under Sections 318(2), 318(4), 61(2), 201, 336, 338, 339, 340(2), 111 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

03Law Applied

Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 empowers the High Court to grant anticipatory bail where the circumstances warrant protection against arrest.

¶ 3

Under Section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, the preliminary acquisition notification is issued to declare the proposed acquisition; under Section 11(4), the restriction on transactions in the notified land operates after issuance of that notification.

04Reasoning

The Court found that the Section 11(1) notification concerning the land was issued on 13 April 2026, whereas the loan had been sanctioned on 18 December 2025.

¶ 6

The documents dated 28 May 2025 relied on by the State were communications from the Sub-Divisional Officer to the Sub-Registrar about proposed acquisition proceedings, not Section 11(1) notifications.

¶ 6

The Court also considered the State’s confirmation that the loan had been repaid, along with the nature of the allegations and the material on record.

¶ 7–8

05Holding

The High Court allowed the anticipatory-bail application.

¶ 9

It directed that, in the event of arrest in Crime No. 209/2026, the applicant be released on a personal bond of ₹25,000 with one surety for the like amount, subject to conditions including availability for interrogation, non-interference with witnesses or the investigation, and appearance before the trial court on each date fixed.
