In brief

The question

1. Whether the adjudicating and first appellate authorities rejected the appellant’s case in a cryptic, non-speaking manner.

The court held

The Tribunal held that the impugned order was non-speaking and had been passed without proper consideration of the appellant’s explanations and evidence.

It also directed

It set aside that order and remitted the matter to the original adjudicating authority to pass a fresh order after considering the appellant’s explanations and supporting documents, within eight weeks of receiving a copy of the Tribunal’s order.

The appeal was disposed of, with no order as to costs.

01Facts

Meera Associates, a registered railway leaseholder engaged in arranging rail transport of goods, appealed under Section 112 of the CGST Act against the first appellate authority’s order concerning FY 2017–18.

¶ 1–2

The department had alleged under-declaration of outward tax liability and excess input tax credit (ITC); the original adjudicating authority confirmed the proposals in the show-cause notice.

¶ 3

The appellant contended that its rail transportation of hatching eggs was exempt as transportation of agricultural produce under Notification No. 12/2017-Central Tax (Rate), and that it had submitted supporting documents to the authorities.

¶ 6.1–6.4, 9(v)–(vii)

The first appellate authority rejected the exemption claim, stating that the appellant had produced no supporting documentary evidence apart from the notification.

¶ 9(viii)

02Issues

i.1. Whether the adjudicating and first appellate authorities rejected the appellant’s case in a cryptic, non-speaking manner.

¶ 8(i)

ii.2. Whether the first appellate authority was correct in stating that no documentary evidence had been produced when the record showed that documents had been submitted.

¶ 8(ii)

iii.3. Whether the appellant should receive a further opportunity for a reasoned determination after examination of its evidence and exemption claim.

¶ 8(iii)

03Law Applied

Section 112 of the CGST Act provides for an appeal to the GST Appellate Tribunal, while Section 73 was invoked in the proceedings concerning the alleged tax shortfall.

¶ 1, 7.1

The Tribunal applied the principle that an administrative or quasi-judicial authority exercising judicial functions must give reasons for its decision, relying on S.N. Mukherjee v. Union of India, (1990) 4 SCC 594.

¶ 10.1

It also considered Notification No. 12/2017-Central Tax (Rate), under which transportation by rail of specified goods, including agricultural produce, is exempt, and Share Medical Care v. Union of India, 2007 (209) E.L.T. 321 (S.C.), for the principle that a claimant is not barred from seeking a notification benefit merely because it was not claimed at the initial stage.

¶ 11.1–11.2

The Tribunal did not finally determine the appellant’s entitlement to the exemption.

04Reasoning

The Tribunal found that the record contained acknowledged written submissions, turnover statements, returns, railway transport documents and other material supporting the appellant’s claim, contrary to the authorities’ assertion that no evidence had been produced.

¶ 9(v)–(vii), 10.0

Because the first appellate authority rejected the claim without addressing that evidence, its order did not meet the requirement of a reasoned, properly considered decision.

¶ 10.1, 10.4

The railway documents identified the transported goods as hatching eggs, and the cited notification and Railway Board circular appeared relevant to whether their transportation qualified for exemption; however, eligibility required fresh consideration by the adjudicating authority.

¶ 11.0–11.3

05Holding

The Tribunal held that the impugned order was non-speaking and had been passed without proper consideration of the appellant’s explanations and evidence.

¶ 12

It set aside that order and remitted the matter to the original adjudicating authority to pass a fresh order after considering the appellant’s explanations and supporting documents, within eight weeks of receiving a copy of the Tribunal’s order.

¶ 12

The appeal was disposed of, with no order as to costs.
