01Facts
The appellant, a Skilled Assistant Grade-I, sought to challenge Corporation proceedings dated 25 May 2006 and 2 March 2021 and obtain regularisation as a Wireman from 1 April 1993, relying on a Labour Court award.
¶ 4, 7 · pp. 2–3He had earlier filed W.P.(MD) No. 6813 of 2009, which he withdrew without liberty to challenge the 2006 proceedings.
¶ 8 · p. 4In 2021, after his representation was rejected, he filed W.P.(MD) No. 6205 of 2021; the Single Judge dismissed it for delay and laches. He appealed that dismissal.
¶ 1, 5–7 · pp. 1–302Issues
i.Whether the appellant’s challenge to the Corporation’s 25 May 2006 proceedings was liable to be rejected for delay and laches, given that the writ petition was filed more than 15 years later without a satisfactory explanation.
¶ 5, 10 · pp. 2, 4–5ii.Whether the appellant’s earlier withdrawal of W.P.(MD) No. 6813 of 2009 without obtaining liberty to challenge the 2006 proceedings affected his ability to pursue the later challenge.
¶ 8, 10 · pp. 4–503Law Applied
The Court applied the principles of delay and laches: an unexplained, inordinate delay in challenging an administrative order may justify dismissal of the challenge.
¶ 8, 10–11 · pp. 4–5It also treated the appellant’s withdrawal of his earlier writ petition without liberty to challenge the 2006 proceedings as relevant to his later attempt to contest them.
¶ 8, 10–11 · pp. 4–504Reasoning
The Court found that the impugned proceedings had been issued on 25 May 2006 and that the appellant challenged them in the present writ petition only after more than 15 years.
¶ 10 · pp. 4–5Although he had earlier filed a writ petition in 2009, he withdrew it without seeking liberty to challenge the proceedings. The Court also found that he had provided no satisfactory explanation for the subsequent delay.
¶ 10–11 · p. 5It therefore held that the Single Judge had correctly dismissed the writ petition on the ground of delay and laches, without needing to determine the merits of the claimed regularisation.
¶ 10–11 · p. 505Holding
The Court answered the issues against the appellant, found no infirmity or illegality in the Single Judge’s order, and dismissed the writ appeal.
¶ 11–12 · p. 5No order was made as to costs.
