In brief

The question

Whether the Purnea ceiling notification could include lands belonging to the eight deities that had already formed part of the concluded ceiling proceedings at Katihar

The court held

The writ application was partly allowed. The Purnea notification was quashed to the extent it included lands of the eight deities established, by comparative verification, to have been covered by the concluded Katihar proceedings

It also directed

The Additional Collector, Katihar, was directed to verify the relevant Gazette notifications and ceiling records, exclude the overlapping lands, and issue a fresh notification to that extent within three months; the exercise was confined to identifying the lands and could not reopen the concluded adjudication

No order as to costs was made

01Facts

The petitioners, including eight deities represented by their shebait, challenged Gazette Notification No. 3060 dated 26 October 2004, issued in ceiling proceedings at Purnea, insofar as it declared their lands surplus

¶ 2, 49

In earlier ceiling proceedings at Katihar, the deities had been held entitled to separate units and, by an order dated 28 April 1990, were permitted to retain 240 acres; only 21.85 acres was declared surplus

¶ 10–11, 50

A later order reducing their entitlement was quashed by a Division Bench, which held that the concluded proceedings could not be reopened

¶ 25–28, 51

The petitioners asserted that some plots in the Purnea notification were the same lands covered by the Katihar proceedings. The State disputed that the proceedings concerned identical lands

¶ 42–48

The High Court found that the schedules disclosed a possible overlap requiring verification against the original records

¶ 53–57

02Issues

i.Whether the Purnea ceiling notification could include lands belonging to the eight deities that had already formed part of the concluded ceiling proceedings at Katihar

¶ 52–56

ii.Whether the claimed overlap and the effect of the prior adjudication could be resolved by comparative verification of the relevant records, without reopening the concluded Katihar proceedings

¶ 55–57

03Law Applied

The Court applied the Bihar Land Reforms (Fixation of Ceiling Area and Acquisition of Surplus Land) Act, 1961, under which ceiling proceedings and surplus-land notifications are undertaken through the statutory process

¶ 4, 11, 44

It relied on the prior decisions recognizing the eight deities as separate juristic persons entitled to separate units, and on the Division Bench’s ruling that the concluded proceedings in Land Ceiling Case No. 202 of 1973–74 could not be reopened under Section 45B in the manner previously attempted

¶ 10, 25–27, 51

Accordingly, lands established to have been covered by those concluded proceedings could not again be included as surplus in the Purnea notification; identifying those lands required comparison of the relevant schedules, plot particulars and records

¶ 55–57

04Reasoning

The Court distinguished the separate origins of the Purnea and Katihar proceedings from the question whether they covered the same plots: the different names of the landholders did not establish that the lands were distinct

¶ 47, 55

The petitioners’ comparative statement identified apparent common plots in Rampur, Belwa and Ramnagar-Vanshi

¶ 36, 53

Because the earlier adjudication and the 1990 order concerning the deities’ entitlement had attained finality, any lands shown by verification to have formed part of that concluded proceeding could not again be treated as surplus in the Purnea notification. Verification was therefore necessary, but could not reopen or reconsider the Katihar adjudication

¶ 56–57

05Holding

The writ application was partly allowed. The Purnea notification was quashed to the extent it included lands of the eight deities established, by comparative verification, to have been covered by the concluded Katihar proceedings

¶ 58

The Additional Collector, Katihar, was directed to verify the relevant Gazette notifications and ceiling records, exclude the overlapping lands, and issue a fresh notification to that extent within three months; the exercise was confined to identifying the lands and could not reopen the concluded adjudication

¶ 59–60

No order as to costs was made
