In brief

The question

Whether the petitioners’ membership and the Society’s self-draw of lots should be verified and regularised by the RCS.

It also directed

It directed the DDA to issue a regularisation letter and permitted the petitioners to apply for leasehold-to-freehold conversion after the DDA’s IDLI portal opened.

The petition was disposed of on those terms.

01Facts

The petitioners sought a direction requiring the Registrar of Cooperative Societies (RCS) to forward their details to the Delhi Development Authority (DDA) for allotment and conversion of Flat No. 704, Saksham Apartments, from leasehold to freehold.

p. 1

The Society had obtained perpetual leasehold rights over the land in July 2001, and the petitioners obtained membership and paid the requisite charges following a self-draw of lots in March 2004.

p. 2

After the Court directed the petitioners and Society to appear before the RCS for verification, the RCS reported that the petitioners’ membership had been verified, the self-draw regularised, and the membership cleared.

03Law Applied

The Court referred to Section 77(1) of the Delhi Cooperative Societies Act, 2003, from whose operation the Lieutenant Governor had regularised the self-draws conducted by 26 Cooperative Group Housing Societies by an order dated 17 October 2011.

It also considered the RCS circular dated 4 June 2026, which invited societies that had conducted self-draws up to 2010 but remained unregularised to submit information so that a proposal could be prepared for the competent authority.
