In brief

The question

Whether the petitioner should be permitted to vend at his designated site pending issuance of a CoV by TVC-II.

The court held

The petition was disposed of with directions permitting the petitioner to vend subject to the stated conditions, and providing that his vending should not be disturbed in the meantime.

It also directed

The CoV is to be issued within three months after TVC-II is constituted, subject to TVC-II’s decision and any plan made under Section 21 of the 2014 Act.

01Facts

The petitioner, a street vendor surveyed in 2025 in the category “Food/Snack with Gas Cylinder/Fire,” had not been issued a Certificate of Vending (CoV).

p. 1

He sought issuance of the certificate and protection from being disturbed at his vending site on the footpath opposite Bhairon Mandir, Nehru Place.

p. 1

The MCD submitted that the CoV would be issued after TVC-II was constituted.

p. 2

02Issues

i.Whether the petitioner should be permitted to vend at his designated site pending issuance of a CoV by TVC-II.

pp. 1–3

ii.Whether the petitioner’s vending should be subject to conditions concerning safety, hygiene, obstruction, and the eventual vending plan.

pp. 3–5

03Law Applied

The Court referred to Section 21 of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014, under which the Town Vending Committee may formulate a vending plan; the Court made its directions subject to any plan adopted by TVC-II under that provision.

p. 5

It also required compliance with the Delhi Street Vendors (Protection of Livelihood and Regulation of Street Vending) Scheme, 2019, and imposed standard conditions governing vending, including hygiene, pedestrian access, non-transferability, and the prohibition on permanent or temporary structures.

pp. 3–4

04Reasoning

Because there was no dispute that the petitioner had participated in the survey, and the MCD stated that the CoV would follow constitution of TVC-II, the Court permitted him to vend in the interim, subject to the prescribed standard conditions.

pp. 2–3

Given his food-and-gas category, it additionally required use of a small gas cylinder, restriction to a space that would not obstruct pedestrians or traffic, and maintenance of cleanliness, including a dustbin near the vend.

pp. 4–5

The interim arrangement remained subject to TVC-II’s decision and any vending plan it adopted; the Court clarified that it created no vested rights.

p. 5

05Holding

pp. 3–5
